Advocate Health and Hospitals Corp. is off the hook in a class-action lawsuit resulting from a data breach that exposed more than four million patient records after an Illinois judge dismissed the suit with prejudice Friday.
Judge James Murphy in the Kane County Circuit Court ruled that plaintiffs in Matias Maglio et al., vs. Advocate didn't have legal standing nor did they prove damages resulting from the breach last summer in their case against the Downer's Grove, Ill.-based hospital system, according to a report in Modern Healthcare.
Murphy's ruling marks the second time Advocate has dodged a class-action suit spawned by the breach, in which thieves stole four computers from the Advocate Medical Group in Park Ridge. In May a judge in another Illinois court tossed out a similar suit.
