Judge: Spamhaus to stay

Spamhaus is staying on the web - in its domain - according to a ruling from a federal judge in Illinois.

Judge Charles Kocoras, of U.S. District Court in Northern Illinois, turned down a motion from e360 Insight, a firm the U.K.-based nonprofit had listed as a spammer, for Spamhaus' domain to be pulled from the web.

Spamhaus' legal problems with e360 Insight began when the company objected to Spamhaus listing it as a spammer and filed an action in an Illinois court. Spamhaus did not appear in court and e360 won a court order by default. The company then demanded that the Internet Corporation for Assigned Names and Numbers (ICANN) strip Spamhaus of its domain.

ICANN, however, responded that it did not have the authority to do so.

Steve Linford, Spamhaus chief executive, told SCMagazine.com that his organization was confident of court victory.

"We've got a huge amount of spam evidence on this, and since the lawsuit broke on the internet, people have been contacting us saying, ‘We've been getting spam from this guy,'" he said. "We're accepting all offers saying that people will testify, together with some networks and some large ISPs (internet service providers)."
